Workers’ Compensation in New Jersey
The New Jersey workers’ compensation system is a social benefit program that addresses the need to provide wage replacement and medical benefits to injured workers. Under this system, NJ employers are required to carry no-fault insurance that pays various benefits to workers who are injured within the scope of their employment. Workers’ compensation insurance is different than health insurance or life insurance, and only provides benefits following an injury that takes place during the course of employment.
Workers’ Compensation Benefits
The basic benefits that are available to injured workers under the Workers’ Compensation Act include temporary disability benefits, medical benefits and permanent disability benefits. In cases involving fatalities arising in the workplace, dependency and funeral benefits may also be available.
In certain cases, additional disability benefits may be available from other sources, including private temporary and long-term disability plans, New Jersey State Disability, Social Security Disability, company pensions, and sickness and accident insurance plans. The payment of temporary disability benefits through workers’ compensation insurance does not relieve an employer from their obligation to contribute applicable collateral benefits that an injured employee would be entitled to if working. For example, an employer may be required to continue to make pension contributions for an injured employee while the employee is receiving workers’ compensation.
