No-fault insurance or Personal Injury Protection (“PIP”) is a package of insurance that provides medical and other benefits to automobile insurance policyholders immediately after an automobile accident, regardless of who was at fault for the accident.  PIP benefits, however, are generally not available to motorcycle riders in New Jersey.  Indeed, under NJ law, PIP benefits are available only if the injured person is “occupying, entering into, alighting from or using” a qualifying “automobile,” or is an insured pedestrian who is struck by an “automobile.”  Motorcycles are specifically excluded from the statutory definition of automobile in this context.
